1. Platform Nature

BGUN is a classifieds and contact platform for the European firearms community. We provide a space for users to advertise firearms, accessories, and related items, and to connect with other users, licensed dealers, armories, and shooting sports organizations.

BGUN is not a firearms dealer, broker, or retailer. We do not hold any firearms licenses and are not authorized to sell, transfer, or facilitate the sale of any firearms, ammunition, or regulated items.

2. EU Firearms Directive 2021/555

This Platform operates in compliance with Directive (EU) 2021/555 of the European Parliament and of the Council on firearms. Key provisions include:

Recital 44 — Online Advertising

Online classified advertisements for firearms are permitted under EU law, provided that:

• The identity of any potential acquirer is verified by a licensed dealer before any transfer takes place.
• The advertisement clearly states that all applicable national regulations must be respected.
• The platform does not itself facilitate or complete any transaction.

Article 2(4) — Online Acquisition

The acquisition of firearms by means of online services is permitted only if:

• The identity of the acquirer is verified by an authorized person (licensed dealer) before delivery.
• All requirements of the national legislation of the Member State of acquisition are fulfilled.
• The acquirer holds a valid firearms license or permit as required by national law.

3. No Online Sales

No firearms, ammunition, or regulated items may be purchased, sold, or shipped through BGUN. Any listing that appears to offer direct online sale or shipping of firearms is a violation of these terms and applicable law. Such listings will be removed immediately and the user account may be suspended.

4. Licensed Dealer Verification

All users are responsible for verifying the identity and licensing status of any counterparty before arranging a transfer. BGUN provides verification tools and dealer profiles but does not guarantee the accuracy of any information provided by users.

5. National Law Compliance

Firearms laws vary significantly between European countries and even between regions within countries. Users must ensure that:

• They are legally permitted to possess the items they list.
• Any transfer complies with the laws of both the seller's and buyer's country.
• All required documentation, permits, and registrations are completed.
• The transfer is conducted through a licensed dealer where required by law.

6. Age Verification

BGUN requires all users to be at least 18 years of age. This is the minimum age for acquiring firearms in most EU Member States under Directive 2021/555. Some countries may have higher age requirements. Users must comply with the age requirements of their jurisdiction.

7. No Warranty

BGUN makes no warranties regarding:

• The accuracy, completeness, or legality of any listing.
• The reliability or trustworthiness of any user.
• The safety or condition of any item listed.
• The outcome of any transaction or transfer.

8. Limitation of Liability

BGUN shall not be held liable for any damages, injuries, or losses arising from transactions between users, the use of items purchased through the Platform, or any violation of applicable firearms laws. Users assume all risk associated with their use of the Platform and any transactions they enter into.

9. Reporting Illegal Activity

If you become aware of any listing or activity on BGUN that appears to violate applicable firearms laws or these terms, please report it immediately to abuse@bgun.eu. We will investigate all reports and cooperate with law enforcement where required.

10. Cooperation with Authorities

BGUN cooperates fully with law enforcement agencies in all European jurisdictions. We will respond to lawful requests for user information in accordance with applicable data protection laws and our Privacy Policy.
