Terms of Service

1. Acceptance of Terms

By accessing or using BGUN ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform. BGUN reserves the right to modify these terms at any time. Continued use constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years of age to use BGUN. By using the Platform, you represent and warrant that you are of legal age and that viewing firearms-related content is lawful in your jurisdiction. You must comply with all applicable local, national, and international firearms laws.

3. Platform Role — Classifieds Only

BGUN is a classifieds and contact platform only. We do not sell, ship, broker, or facilitate the sale of any firearms, ammunition, or regulated items. All transactions between buyers and sellers are conducted independently and must comply with applicable firearms legislation.

BGUN is not a party to any transaction between users. We do not guarantee the quality, safety, or legality of any items listed. We do not provide buyer or seller protection for transactions.

4. EU Firearms Directive Compliance (2021/555)

In accordance with Directive (EU) 2021/555, particularly Recital 44 and Article 2(4):

• Online classified advertisements for firearms are permitted, provided that the identity of the acquirer is verified by a licensed dealer before any transfer.
• All users must verify the identity and licensing status of any counterparty before arranging a transfer.
• No firearms may be acquired through this Platform without prior identity verification by an authorized person.
• Users must respect all national firearms legislation in their country of residence and any country where a transaction takes place.

5. Prohibited Conduct

• Listing firearms, ammunition, or regulated items for direct online sale
• Offering to ship or deliver firearms through the Platform
• Circumventing identity verification requirements
• Listing items that violate local, national, or international law
• Fraud, misrepresentation, or impersonation
• Harassment, threats, or abusive behavior
• Automated scraping or data collection

6. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You must notify BGUN immediately of any unauthorized use. BGUN reserves the right to suspend or terminate accounts that violate these terms.

7. Intellectual Property

All content on BGUN (logos, text, images, software) is owned by BGUN or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, BGUN shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. BGUN provides the Platform "as is" without warranties of any kind.

9. Indemnification

You agree to indemnify and hold harmless BGUN, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these terms.

10. Dispute Resolution

Any disputes arising from these terms shall be resolved through good-faith negotiation first. If unresolved within 30 days, disputes shall be submitted to the competent courts of Brussels, Belgium. These terms are governed by Belgian law.

11. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
